I only have 5 more years to work thing out.&lt;br&gt;John Michaels;&lt;br&gt;I spoke with you Monday Oct. 26 concerning a problem with how Lane County Commissioners were using federal housing funds, invoicing the federal government for services not rendered in violation of the false claims act.&lt;br&gt;&lt;br&gt;Background&lt;br&gt;We enrolled in HOME TBA in February of 2005 - 2007.&lt;br&gt;HOME TBA is a Federally funded housing program that uses HUD section 8 tenant based assistance rules. The funds are granted to the State of Oregon, they sub-grant funds to Lane County Oregon Board of County Commissioners. The Lane County Commissioners subcontract the case management to a “not for profit”( Community Sharing Program in Cottage Grove, Oregon). &lt;br&gt;Our first case management worker was Maria Lopez. We received an accommodation that I was to stay in the home with my wife because of her disability and not have to participate in the job search requirements of the HOME TBA program, our “Plan for Self Sufficiency” was constructing an Online Jewelry Store that accepted credit cards, through PayPal, while she and I stocked the store from estate sales and thrift store purchases. This plan was approved by her therapist, Maria Lopez, Community Sharing, Lane County and the State of Oregon. Part of the requirements of the HOME TBA program was that in return for enhanced case management services we participate in a “Plan for Self Sufficiency”, this differentiates it from a regular Section 8 which is only rental subsidy which has no extra services for increased case management that leads to Self Sufficiency. The enhanced case management services and program requirements are detailed in the block grant submitted to the federal government by the Housing and Community Services Department of the State of Oregon. This grant submittal forms the contractual provisions and services that will be provided by the State of Oregon and its sub-grantee’s. It is the duty of the State of Oregon and the Lane County Board of County Commissioners to make sure that the “not for profit” is delivering the services required in the state grant contract. Failure to provide oversight of federally funded programs can result in future denial of federal funding, fines and/or federal imprisonment. Use of fraudulent writings to deny services to a client carries penalties and is specifically listed at the end of the “lease agreement” signed by the client, the landlord and Lane County. Records are required to be kept for 5 years. The statute of limitations are further extended because this complaint includes a RICO triggering firearm offence, complaint documented by Lane County Sheriff’s report and Lane County DA case file Re: us v Alvin Johnson, the RICO statute of limitations goes for 7 years after the termination of investigation by Lane County DA. &lt;br&gt;&lt;br&gt;After speaking with U. S. Senator Ron Wyden’s staff member John Michaels on Monday October 26 2009, he requested that I send him a fax containing the specific allegations that I believe were not properly addressed in our original HUD complaint. I request U. S. Senator Ron Wyden’s office facilitate a RICO based HUD investigation of this situation. &lt;br&gt;&lt;br&gt;Facts:&lt;br&gt;Community Sharing, Nancy Glines then Executive Director, David Flores, then case worker for us and Faye Stewart, member of Community Sharing Board of Directors, failed to provide services required by HOME TBA grant, including improper and insufficient case management documentation, failure to provide any supportive services relating to the online store such as referrals to state agencies like Minority Women Small Business group specifically mentioned in State of Oregon block grant request, failure to even view the online store at WWW.AtticJewelry.Com as evidenced by web logs and absence of them registering on website. Failure to do a proper evaluation of web site by a competent person. Failure to even put a notice of the website in the Community Sharing newsletter during the holiday season, The lack of publication in their newsletter shows a total lack of even the smallest iota of support by the “not for profit” in this situation.&amp;nbsp; Lack of paperwork concerning the “savings account” provision of the HOME TBA Program. Lack of required support when clients vehicle broke down which compromised their ability to shop for food, get medicine, visit doctors and therapists, and go to required HOME TBA case meetings. The Community Sharing Program has had a long association with South Lane Wheels, which shares office space with them, and was listed in their newsletter as a provider of these exact services. Failure to notify the clients of this available service to a medically dependent rural isolated client during the winter months is inconceivable and unconscionable. The informing of locally available services such as this transportation service is something that doesn’t cost the “not for profit” any funds and is listed in the block grant as a service that should be provided by the case management team under referrals to local state, government and local services. This provision allows the case management to parlay outside services into their program without incurring added costs.&amp;nbsp; Failure to notify the client of a service provided by the “not for profit’s” sister agency shows a total lack of concern for the health and safety of the client. &lt;br&gt;&lt;br&gt;When we notified the executive director, Nancy Glines, Lane County Human Services, Nancy Waggoner, and State of Oregon Housing and Community Services, Jodie Jones and Mary Gentry that David Flores was not providing required services under the HOME TBA Contract, they retaliated by removing us from the program using 2 known fraudulent writings. In the termination of services letter sent to us by Nancy Waggoner she states that we will be terminated because of not complying with David Flores’ “Plan for Self Sufficiency” and being evicted by our landlord. To date no one has produced the actual signed, by us and David Flores, document. During a limited hearing conducted by Steve Manela, Lane County Human Services Commission, I requested that they fax to me the document from our case file that they used in our hearing. They did not send the document from our case file but rather downloaded a different document from the internet, resized it, taped it to a sheet of paper and faxed that document to us. They knew that it was not from our Community Sharing case file. They proffered a fake document instead of the requested document. This clearly violates the warning against using fraudulent writings to deny services listed at the end of the HOME TBA Contract. The “eviction notice” by the landlord was based upon a “Month to Month” rental agreement sent to the attorney, Dean Kaufman, of Alvin Johnson, landlord, By Nancy Waggoner’s office. The eviction never went to court, but Nancy Waggoner cut off HOME TBA assistance funds before the case could have been heard by a court according to the “eviction notice”. Lane County Human Services Commission knew that they did not send the HUD approved HOME TBA One Year Lease that included federal protections to the landlord’s attorney but sent a 2 year old “free internet form” “Month to Month rental agreement”. The document has printed on it “free internet rental form” and in no stretch of the imagination could have been confused with the HUD approved One Year Lease Agreement signed and sent to us by Nancy Waggoner’s office 2 months prior. Dean Kaufman, as a landlord tenant attorney and former judge, could not mistake a one page “free internet rental form” for a lease that was used by a state regarding federal housing funds. I became aware that the “eviction notice” was based upon a fraudulent writing through a series of exchanged e-mails with Dean Kaufman. In those e-mails he admits that the eviction notice is based on the wrong document and faxes to me the document he received from Nancy Waggoner’s office. The eviction was dropped and Dean Kaufman and Alvin Johnson offered to allow us to remain in the home at 81723 Mahr Lane Creswell, Oregon for the remainder of the one year lease period “without any further payment of rent”. Our HOME TBA funds had been cut off by Nancy Waggoner prior to this time. HOME TBA funds are applied to rent and utilities. So our HOME TBA subsidy could have been applied to our electricity bills while we were not required to pay rent. &lt;br&gt;&lt;b&gt;Then the landlord started shooting at us with a shotgun&lt;/b&gt;. He shot at us 14 times over a two week period. We called 911 twice. Lane County Sheriff’s Deputies came twice. A Rico triggering firearm complaint was filed. Reports were written. Video tape was taken into evidence (video available at &lt;a href="http://www.youtube.com/watch?v=nQQ4ystsAWo"&gt;http://www.youtube.com/watch?v=nQQ4ystsAWo&lt;/a&gt;&amp;nbsp; with added editorial comments added).&lt;br&gt;&amp;nbsp;The case was turned over to the Lane County DA’s Office. The DA’s Office, which relies on the Lane County Board of Commissioners and grants from the Department of Justice for the majority of their funding, did not pursue this case but let it sit for 2 years un-prosecuted. Faye Stewart sat on both the Lane County Board of Commissioners and the Board of Community Sharing. Nancy Glines was Executive Director of Community Sharing and heavily involved with securing “Department of Justice” grants for Lane County and listed as a “cohort” of Faye Stewart &lt;br&gt;&lt;br&gt;“RIPPLE, Rural Information, Practices &amp;amp; Peer Learning Exchange, &lt;br&gt;“Networking: Not a Naughty Act&lt;br&gt;&amp;nbsp;http://www.ripplenw.org/&lt;br&gt;Networking is a misunderstood practice. It has been portrayed as the self-serving pastime of furthering one’s interests by socializing with the right people. Stephen Vorhes and Recording Secretary Melissa Zimmer were also present." ...&lt;br&gt;&lt;/p&gt;&lt;b&gt;"b.&amp;nbsp; PUBLIC HEARING AND ORDER 06-5-17-16/In the Matter of Considering a Ballot Measure 37 Claim and Deciding Whether to Modify, Remove or Not Apply Restrictive Lane Use Regulations in Lieu of Providing Just Compensation (PA 05-6478, Stewart).&lt;br&gt;Commissioner Stewart stated that due to state law, he had to remove himself from this hearing as he has a direct conflict, as this is his dad’s claim.&amp;nbsp; He turned the meeting over to Commissioner Green and left the room.&lt;/b&gt;&lt;br&gt;Howe explained that the applicant acquired the property in 1969 and it was unzoned at that time.&amp;nbsp; He indicated the property is on Stewart Hills Lane, four miles southwest of Cottage Grove.&amp;nbsp; He said it is currently zoned rural residential, five-acre minimum and is 13 acres in size.&amp;nbsp; He said the information the applicant provided was a realtor’s opinion of the value.&amp;nbsp; He said the Board has to determine if they feel it represents a reduction in fair market value.&amp;nbsp; He said the applicant wants to divide the property into smaller lots.&amp;nbsp; He asked if the Board was comfortable with the value reduction opinion, then it would be a valid claim because of the date of acquisition.&lt;br&gt;Commissioner Green opened the Public Hearing.&lt;br&gt;Green asked if there were any other ex parte contacts.&lt;br&gt;There were none.&lt;br&gt;Bruce Stewart, Cottage Grove, stated he is the applicant.&amp;nbsp; He purchased the property in 1969 and at that time it was unzoned.&amp;nbsp; He said he bought it to enjoy and a place for his children to have a future home.&amp;nbsp; He said land use laws and zoning didn’t let him previously build on the land.&amp;nbsp; He tried to apply for a RR2 zoning but was denied.&amp;nbsp; He indicated he presently has two legal lots of 13 acres.&amp;nbsp; He stated that part of buying the property was a form of retirement investment.&amp;nbsp; He stated he met all of Measure 37’s criteria.&lt;br&gt;John W. Gorny, Cottage Grove, stated they had nothing against the development because Stewart’s first priority is family. He was concerned about the traffic, the water problem and in order to get onto his property, they have to take Stewart Hills Road.&amp;nbsp; He said the road is a gravel road and it is a problem for them with the dust.&lt;br&gt;Nolene Wheeler, Cottage Grove, said she is a neighbor.&amp;nbsp; She said she is neutral on this.&amp;nbsp; She indicated she lives on 3/10th of an acre that is bordered by Mosby Creek Road.&amp;nbsp; She lives in a house there because her mother bought the property in 1962 and two cabins were built on it before it was controlled by the County.&amp;nbsp; She said the County let them rebuild a house that was damaged by a fallen tree and to rebuild, they were grandfathered in because they already had a septic and well system.&amp;nbsp; She was concerned about being a streamside resident.&amp;nbsp; She hoped her neighbors would find satisfaction in the process.&lt;br&gt;Michael King, Cottage Grove, stated he is a landowner who lives on property adjacent to Bruce Stewart.&amp;nbsp; He said the land use regulations are there for a purpose.&amp;nbsp; He commented with the division of land there would be more people by the creek.&amp;nbsp; He said people come and swim in the creek and discard trash.&amp;nbsp; He stated that the land is for everyone and he doesn’t understand why people are able to split land and destroy it. &amp;nbsp;&lt;br&gt;Samuel King, Cottage Grove, said he had been affected by the previous actions of Bruce Stewart.&amp;nbsp; He added that this claim would change the zoning of the land.&amp;nbsp; He thought the Measure 37 claim should be rejected because there would be a negative effect on people in the community.&amp;nbsp; He was concerned about trespassing.&amp;nbsp; He thought a public nuisance would be increased traffic. He said they would have to go over a small bridge to travel in the area.&amp;nbsp; He stated that there would be pollution from the land being constructed on.&amp;nbsp; He said Stewart’s application discusses other property that isn’t creek side.&amp;nbsp; He commented that Stewart’s claims were speculation on the loss.&amp;nbsp; He said that Stewart only showed one instance where there might be a decrease in value.&lt;br&gt;Jim Belknap, stated he is the principle broker for Territorial Land Company, Cottage Grove.&amp;nbsp; He said he does land use consulting but they didn’t represent Stewart in the preparation of the application. He indicated he was asked to prepare the valuation to determine what type of compensation could be requested under a Measure 37 claim.&amp;nbsp; He said one of the problems with Measure 37 is that it requires almost a speculative approach of value of what could be done if current land use regulations were not applied to a piece of property. He noted when Stewart acquired the property, there was no zoning in effect and he could have done any type of development.&amp;nbsp; He was given the assignment to determine the highest and best use of the property.&amp;nbsp; He said it was his opinion, that the property as it is currently zoned (rural residential, with a greater level of density) has the highest and best use.&amp;nbsp; He added abutting Stewart’s property is a higher level of density, lots between a half and one acre in size.&amp;nbsp; He said they evaluated the property as if 13 single family residential building sites could be developed.&amp;nbsp; He added it would be a one-acre lot where a septic system could be installed and a well could be constructed that would meet state DEQ standards.&amp;nbsp; He said they estimated what 13 building sites would be worth and they deducted the development costs of the project and arrived at a figure.&amp;nbsp; He said they also determined the current market value of the property and the difference between the two was the compensation figure of $445,000.&lt;br&gt;Scott Pyle, Cottage Grove, said his concern is water and sewer.&amp;nbsp; He said they have a shallow well but it supplies them until August.&lt;br&gt;There being no one else signed up to speak, Commission Green closed the Public Hearing.&lt;br&gt;Green asked about the legitimacy of the claim and what the interpretation is.&lt;br&gt;Vorhes said the sections that define exempt regulations are not considered restricted land use regulations under the measure.&amp;nbsp; He added that some of the descriptions of situations continue to apply and cannot be waived.&amp;nbsp; He didn’t think the current zone lot division limitations fit into those categories.&amp;nbsp; He said some of the regulations continue to apply to address adequate water and sanitation concerns.&amp;nbsp; He said those regulations are not being recommended to be waived.&amp;nbsp; He said the only restrictions that are being waived are the ones that limit the division of land.&amp;nbsp; He noted that the owner of the property, once the County and state have taken action on Measure 37 claims will still need to apply and show compliance with all of the health and safety regulations that continue to apply to this property. He added that federal and state pollution control regulations would continue to apply.&lt;br&gt;Sorenson indicated the current ordinance in effect requires an applicant for Measure 37 claim to have an appraisal.&amp;nbsp; He asked if Van Vactor waived the appraisal requirement.&lt;br&gt;Van Vactor said in reviewing the claim the valuation information they had used comparable sales.&amp;nbsp; He said in previous discussions with the Board on the minimum requirements for discussion on the valuation question of Measure 37, he recommended that as long as they have comparable sales of actual sales and not just assessed valuation and an analysis to the regulation, they had met the minimum requirements of Ballot Measure 37.&amp;nbsp; He said this claim meets the requirement for a waiver.&lt;br&gt;&lt;b&gt;MOTION: to approve ORDER 06-5-17-16.&lt;br&gt;Morrison MOVED, Green SECONDED.&lt;br&gt;VOTE: 2-2&amp;nbsp; (Dwyer, Sorenson dissenting) MOTION FAILED.&lt;/b&gt;"&lt;br&gt;&lt;br&gt;&amp;nbsp;&lt;br&gt;(At this point the motion has failed. OTHER BUSINESS&lt;br&gt;ORDER 06-5-17-16 Considering a Ballot Measure 37 Claim and Deciding Whether to Modify, Remove or Not Apply Restrict Land Use Regulations in Lieu of Providing Just Compensation (Bruce Stewart/PA 05-6478).&lt;br&gt;&lt;b&gt;Dwyer said Stewart is claiming the rule of necessity and is not allowed to engage in a debate.&amp;nbsp; He said they had the debate and the motion had failed on a 2 to 2 tie&lt;/b&gt;.&amp;nbsp; He said they have the Rule of Revision that requires Commissioner Stewart to vote and not to participate in the debate.&amp;nbsp; He said under the Rule of Revision they are going to revisit the Measure 37 claim.&lt;br&gt;&lt;b&gt;Van Vactor indicated that Vorhes sent the Board an e-mail and paper copy on June 5 that explained this procedure.&lt;/b&gt;(Where is that e-mail? ed. note)&lt;br&gt;Vorhes said in putting this matter on the agenda, they could hear from Stewart on whether or not he has reviewed the record.&amp;nbsp; He stated that any other discussion or debate is not allowed under ORS 244.120.&lt;br&gt;Dwyer thought the Rule of Necessity was a lousy rule.&amp;nbsp; He advised Stewart to participate in a debate before this. He said the fact that Stewart is related to his father does not deprive his father of certain rights. &lt;br&gt;MOTION: to approve ORDER 06-5-17-16.&lt;br&gt;Green MOVED, Morrison SECONDED.&lt;br&gt;Sorenson objected, he said the motion was already made.&amp;nbsp; Dwyer overruled his objection.&lt;br&gt;Green said when the applicant made the application, he supported it at that time, not because it was any relative or relationship.&amp;nbsp; He said the applicant stated he intended to do with the property what other claimants had asked for. Green recalled there were 5-0 votes on those.&amp;nbsp; He said by lifting the restriction, it allows that person to go forward to proceed in a manner which they had allowed in other applications.&amp;nbsp; He was trying to be consistent. He supported the motion.&lt;br&gt;Dwyer asked if they were required to vote, even if there was a conflict.&lt;br&gt;&lt;b&gt;Vorhes said in ORS 244.120(1), the rule that creates this is an elected public official other than a member of the legislative assembly, or an appointed public official serving on a board or commission shall, when met with a conflict potential or actual, announce the conflict when it is an actual conflict.&lt;/b&gt; (see above excerpt for exact wording. ed note) Then the first step is to refrain from participating as a public official in any discussion or debate on the issue out of which the conflict arose.&amp;nbsp; He indicated the Rule of Necessity comes in only if necessary to meet a requirement of a minimum number of votes to take official action.&amp;nbsp; &lt;b&gt;He said the rules for the legislature as he described is in ORS 244.120(1)(a) that states if a public official is a member of the legislative assembly, the public official shall announce publicly pursuant to the rules of the house of which the public official is a member the nature of the conflict before taking any action in the capacity as a public official.&lt;/b&gt;(He has now shifted to a part of ORS 244 that does not pertain to a county commissioner. ed note)&lt;br&gt;Sorenson asked how this was brought up without public notice.&lt;br&gt;Van Vactor indicated he asked the agenda team whether they wanted to bring it up today or to schedule it later.&amp;nbsp; He said the discussion by the agenda team was to have it today.&lt;br&gt;Dwyer explained it was his vote and Sorenson’s vote that caused this situation.&amp;nbsp; He stated he wouldn’t change his vote.&lt;br&gt;Van Vactor added that during adjustments to the agenda that this matter would be brought up.&lt;br&gt;Stewart stated that under the Rule of Necessity, he had reviewed the documents that were presented, the public testimony on tape and the written comments that had been sent around in the mail.&amp;nbsp; They use this designation to make people think they are referring to a community when they are actually meaning their tight knit group of “cohorts” in the Service of the Foundation scheme. &lt;br&gt;&lt;br&gt;The Foundation scheme is to effect social change outside of the established political sphere by diverting Federal and State resources to “Not for Profits” controlled by “Community Foundations”. The “Community Foundations” are arranged as a pyramid from Family, City, region, State, Nation, Council.
